1. INTRODUCTION & PURPOSE
These Community Guidelines & Marketplace Conduct Policy ("Guidelines") establish the standards, rules, expectations, and conduct requirements governing use of the Sell My Project ("SMP," "we," "our," or "us") marketplace platform, Auctions, Garage features, community tools, communications, listings, and related services (collectively, the "Platform").
The purpose of these Guidelines is to promote a safe and trustworthy marketplace environment; fair and transparent Auctions; respectful community engagement; honest marketplace participation; lawful conduct; marketplace integrity; and the protection of users, Projects, transactions, and community interactions across the Platform. These Guidelines apply to all users, including Buyers, Sellers, Garage accounts, builders, Crew participants, visitors, and any individuals or entities interacting with the Platform.
These Guidelines supplement and form part of SMP's Terms of Service, Buyer Terms, Seller Terms, Privacy Policy, Auction Rules, and related Platform policies. By accessing or using the Platform, users agree to comply with these Guidelines and all related Platform rules and policies.
In the event of any conflict between these Guidelines and the Terms of Service or related legal agreements, SMP may interpret and apply the applicable provisions in a manner intended to protect marketplace integrity, operational security, user safety, and lawful Platform operations. Violations of these Guidelines may result in enforcement action under the Terms of Service and related Platform policies.
These Guidelines apply to all conduct, activity, communications, content, transactions, and marketplace participation occurring through or relating to the Platform. This includes Auctions and Send It activity, listings and Project disclosures, Garage profiles, comments and public Q&A, Crew participation, bids and transactions, payment activity, social and community engagement, uploaded content, promotional activity, and interactions between users or with SMP personnel.
These Guidelines apply regardless of whether conduct occurs publicly, privately, electronically, verbally, through third-party integrations, or through off-platform activity connected to marketplace participation or Platform use.
SMP reserves broad discretion to interpret, enforce, investigate, and administer these Guidelines and all related Platform policies. SMP may review or moderate content, remove listings or comments, restrict marketplace activity, suspend or terminate accounts, void bids or Auctions, freeze transactions or payouts, investigate suspicious conduct, preserve records, cooperate with legal authorities, and take other operational, technical, legal, or enforcement measures reasonably necessary to protect the Platform, its users, marketplace integrity, or compliance obligations.
Enforcement decisions may be made with or without prior notice, as reasonably necessary, to address fraud, abuse, security risks, legal concerns, operational issues, or marketplace integrity matters. SMP is not obligated to publicly disclose enforcement decisions, investigative procedures, moderation standards, or internal risk-management practices.
2. COMMUNITY EXPECTATIONS
2.1 Respectful Conduct
Users are expected to interact with Buyers, Sellers, Garage members, Crew participants, SMP personnel, and other marketplace users in a respectful, professional, and lawful manner at all times. Users may not engage in abusive, threatening, harassing, hateful, discriminatory, deceptive, intimidating, or disruptive conduct through the Platform or in connection with marketplace activity.
Respectful conduct applies to listings and disclosures, comments and public Q&A, Auction participation, transaction negotiations, community engagement, support communications, and interactions relating to Projects, transactions, or marketplace participation. SMP encourages constructive participation that supports a positive and trustworthy automotive enthusiast community.
2.2 Honest Marketplace Participation
Users are expected to participate honestly, transparently, and in good faith throughout all marketplace activity. Buyers, Sellers, and other participants must provide accurate information, make truthful disclosures, submit legitimate bids, engage in authentic marketplace activity, and conduct lawful transactions.
Users may not engage in fraud, misrepresentation, shill bidding, fake listings, deceptive conduct, payment abuse, manipulation of marketplace systems, false ownership claims, or conduct intended to mislead other users or distort marketplace activity. Marketplace trust depends on accurate information, fair participation, and transparent user conduct.
2.3 Good-Faith Communications
Users are expected to communicate honestly, professionally, and in good faith when interacting through the Platform or in connection with marketplace activity. Communications must not include false or misleading statements, fraudulent promises, impersonation, harassment or intimidation, abusive language, unlawful threats, deceptive negotiation tactics, or attempts to pressure users into improper transactions or conduct.
SMP reserves the right to moderate, review, preserve, restrict, or investigate communications where reasonably necessary to protect users, enforce Platform policies, maintain marketplace integrity, or comply with legal obligations.
2.4 Accountability for User Activity
Users are responsible for all activity conducted through their accounts, devices, Garage profiles, payment methods, and marketplace participation. Users are expected to maintain accurate account information, safeguard account credentials, comply with Platform rules, and ensure that their activity remains lawful and consistent with these Guidelines.
Users may be held responsible for content they publish, bids they submit, listings they create, transactions they initiate, communications conducted through their accounts, and actions taken using their login credentials or marketplace access. Failure to maintain account security or comply with Platform rules may result in enforcement action, account restrictions, transaction cancellation, or removal from the marketplace.
2.5 Protection of Marketplace Trust
SMP is committed to maintaining a fair, secure, transparent, and trustworthy marketplace environment for automotive enthusiasts and marketplace participants. Users are expected to avoid conduct that may undermine marketplace confidence, operational stability, Auction integrity, user safety, or community trust.
Users must not interfere with fair marketplace participation, legitimate Auction activity, transaction reliability, Platform operations, fraud-prevention systems, moderation procedures, or community integrity. SMP reserves the right to investigate suspicious conduct, restrict harmful activity, preserve evidence, cooperate with legal authorities, and take enforcement action reasonably necessary to protect marketplace trust, operational security, and the overall integrity of the Platform.
3. MARKETPLACE CONDUCT RULES
3.1 Lawful Use of the Platform
Users may use the Platform only for lawful purposes and in compliance with applicable laws, regulations, court orders, payment-network rules, intellectual property rights, consumer-protection requirements, vehicle-transfer laws, and Platform policies. Users may not use the Platform in connection with unlawful conduct, fraudulent schemes, deceptive practices, money laundering, payment abuse, identity fraud, or other prohibited activity.
Users are solely responsible for ensuring that their use of the Platform, participation in Auctions, vehicle listings, communications, transactions, and marketplace conduct comply with all laws applicable to their jurisdiction and marketplace activity.
3.2 Accurate Listings & Disclosures
Sellers and other marketplace participants must provide accurate, complete, and non-misleading information relating to Projects, listings, transactions, ownership, title status, vehicle condition, modifications, defects, and related marketplace activity. Users may not submit false disclosures, misleading descriptions, manipulated photos or videos, fake documentation, inaccurate VIN information, fraudulent restoration claims, or incomplete ownership information intended to mislead marketplace participants.
Marketplace transparency and user trust depend on accurate listings and honest disclosures. SMP reserves the right to review, moderate, remove, restrict, or investigate listings or disclosures that appear deceptive, incomplete, suspicious, or inconsistent with marketplace integrity standards.
3.3 Authentic Marketplace Activity
All marketplace participation must be legitimate, authentic, and conducted in good faith. Users may not manipulate marketplace systems, artificially inflate engagement, create fake activity, use deceptive accounts, generate false traffic, or engage in conduct intended to distort Auctions, listings, Trust Scores, community visibility, or marketplace interactions.
Prohibited conduct includes fake bids or inquiries, duplicate-account manipulation, deceptive engagement activity, fabricated marketplace interactions, coordinated manipulation schemes, or attempts to interfere with accurate marketplace activity or user decision-making. SMP may investigate suspicious activity and take enforcement action reasonably necessary to protect marketplace integrity and operational stability.
3.4 Fair Auction Participation
Users participating in Auctions must do so honestly, fairly, and in compliance with applicable Auction rules and Platform policies. Buyers may submit bids only where they genuinely intend and are financially capable of completing the applicable transaction.
Users may not engage in shill bidding, artificial price inflation, coordinated bidding schemes, Auction interference, fraudulent bid activity, bid suppression, fake bidding behavior, or conduct intended to manipulate Auction outcomes or undermine marketplace fairness. SMP reserves broad discretion to review Auction activity, investigate suspicious bidding conduct, void bids, suspend Auctions, restrict participation, or take additional enforcement action where reasonably necessary to protect marketplace integrity.
3.5 Compliance with Transaction Obligations
Users are expected to honor their marketplace commitments and comply with obligations arising from Auctions, transactions, listings, bids, payments, vehicle transfers, and related marketplace activity. Buyers and Sellers must complete transactions in good faith and cooperate reasonably throughout the transaction process.
Failure to complete transactions, submit required payments, transfer ownership documents, coordinate vehicle pickup, comply with payment obligations, or otherwise fulfill marketplace responsibilities may result in enforcement action, account restrictions, transaction cancellation, financial liability, or removal from the Platform.
3.6 No Circumvention of Platform Rules
Users may not attempt to circumvent SMP's Platform rules, marketplace protections, fees, moderation systems, payment procedures, enforcement mechanisms, or operational processes.
Prohibited circumvention activity includes directing users off-platform to avoid fees, interfering with active Auctions, evading suspensions or restrictions, creating replacement accounts after enforcement action, bypassing verification requirements, avoiding payment obligations, or using the Platform solely to generate off-platform transactions or leads. SMP reserves the right to investigate suspected circumvention activity and may suspend accounts, void marketplace activity, restrict transactions, freeze payouts, remove listings, or take additional legal, operational, or enforcement measures where appropriate.
4. PROHIBITED CONDUCT
To maintain a safe, fair, transparent, and trustworthy marketplace environment, all users must comply with SMP's conduct standards. The Platform is intended for legitimate participation in the automotive marketplace, community engagement, Auctions, and lawful transactions involving Projects and enthusiast vehicles. Any conduct that undermines marketplace integrity, user safety, operational stability, Auction fairness, legal compliance, or community trust is strictly prohibited.
Users may not engage in fraudulent, deceptive, abusive, unlawful, manipulative, harmful, or disruptive conduct through or relating to the Platform, whether occurring publicly or privately, electronically or verbally, through third-party integrations, or in connection with off-platform marketplace activity associated with SMP. SMP reserves broad discretion to investigate suspicious conduct, preserve evidence, restrict marketplace access, suspend or terminate accounts, freeze transactions or payouts, cooperate with regulators or law enforcement authorities, and take any additional enforcement action reasonably necessary to protect the Platform, its users, marketplace integrity, and operational security.
- Engaging in fraudulent, deceptive, misleading, unlawful, or bad-faith conduct relating to Auctions, listings, payments, communications, Garage activity, transactions, marketplace participation, or Platform operations.
- Submitting false ownership claims, forged documentation, fake VIN information, fraudulent title records, manipulated disclosures, deceptive transaction information, or inaccurate Project descriptions intended to mislead Buyers or marketplace participants.
- Participating in payment fraud, chargeback abuse, unauthorized payment activity, refund manipulation, identity fraud, or any conduct intended to improperly obtain money, property, marketplace advantages, or confidential information.
- Engaging in shill bidding, coordinated bidding schemes, artificial price inflation, fake bidding activity, bid suppression, Auction interference, or any conduct intended to manipulate Auction outcomes, distort marketplace pricing, or undermine fair bidding activity.
- Bidding on one's own listing, coordinating bids with third parties, using duplicate accounts to influence Auctions, artificially inflating engagement or visibility, interfering with legitimate bids, or creating deceptive Auction activity.
- Creating fake, deceptive, misleading, fraudulent, or unauthorized listings, Garage content, comments, promotional material, or marketplace communications.
- Uploading manipulated photos or videos, forged documents, fabricated build details, inaccurate restoration claims, false condition disclosures, misleading repair history, or deceptive Project information.
- Listing vehicles or Projects without lawful ownership, transfer authority, title rights, or legal authorization to sell, transfer, or market the applicable vehicle or Project.
- Concealing known defects, omitting material information, misrepresenting damage history, or otherwise misleading users regarding vehicle condition, restoration quality, operability, title status, or marketplace legitimacy.
- Engaging in abusive, harassing, hateful, threatening, discriminatory, defamatory, intimidating, bullying, stalking, or otherwise harmful conduct toward users, SMP personnel, moderators, service providers, or third parties.
- Using hate speech, discriminatory language, targeted attacks, abusive messaging, intimidation tactics, harassment campaigns, or conduct intended to create an unsafe, hostile, or disruptive marketplace environment.
- Threatening violence, encouraging unlawful conduct, promoting dangerous activity, engaging in extortion or coercion, intimidating users through threats, or compromising the safety of marketplace participants, transactions, or SMP personnel.
- Participating in spam, phishing, scams, fraudulent solicitations, fake payment requests, deceptive advertising, unauthorized promotional campaigns, malicious links, mass messaging abuse, or schemes intended to deceive users or improperly obtain information or payments.
- Impersonating another person, business, Garage, brand, marketplace participant, or SMP representative, or creating deceptive accounts, false identities, or misleading verification information.
- Misrepresenting identity, authority, affiliation, marketplace status, ownership rights, transaction legitimacy, or business relationships connected to the Platform or marketplace activity.
- Using the Platform for unauthorized commercial activity unrelated to legitimate marketplace participation or approved Platform functionality.
- Conducting unauthorized advertising, affiliate abuse, deceptive commercial solicitations, lead harvesting, unauthorized resale activity, misuse of marketplace data, or unapproved commercial exploitation of Platform activity or user information.
- Attempting to circumvent SMP's fees, marketplace protections, moderation systems, payment procedures, transaction requirements, Auction systems, enforcement measures, or operational processes.
- Soliciting off-platform payments, directing users away from the Platform to avoid fees or protections, interfering with active Auctions, using marketplace activity solely to generate off-platform transactions, or evading Platform rules or enforcement procedures.
- Engaging in malicious, unauthorized, technically abusive, or disruptive activity affecting the Platform, marketplace systems, operational infrastructure, security protections, users, or third-party services connected to the Platform.
- Participating in hacking, malware distribution, phishing attacks, credential theft, denial-of-service activity, unauthorized scraping, automated abuse, reverse engineering, exploitation of vulnerabilities, circumvention of security systems, or unauthorized access to systems, accounts, or marketplace data.
- Uploading, publishing, distributing, transmitting, or facilitating unlawful content, illegal activity, criminal conduct, stolen-property listings, unlawful sales activity, prohibited vehicle transactions, fraudulent financial activity, unlawful surveillance, or violations of applicable laws, regulations, court orders, or legal obligations.
- Infringing or misusing copyrights, trademarks, trade dress, patents, publicity rights, confidential information, proprietary content, or other intellectual property rights belonging to SMP or third parties.
- Uploading infringing materials, unauthorized reproduction of marketplace content, misuse of branding, counterfeit listings, unauthorized copying of photos or media, or unlawful use of copyrighted materials through the Platform.
- Improperly collecting, disclosing, distributing, selling, exploiting, or misusing personal information obtained through marketplace participation or Platform use.
- Engaging in unauthorized data harvesting, doxxing, sharing private information without authorization, misuse of transaction data, unauthorized marketing using user information, or conduct violating privacy or data-protection laws.
- Interfering with Platform functionality, moderation systems, fraud-prevention tools, Trust Scores, engagement metrics, reporting systems, community participation, legitimate marketplace activity, or operational stability.
- Participating in coordinated abuse campaigns, repeated policy evasion, manipulation of reputation systems, disruption of marketplace operations, abusive use of reporting systems, interference with moderation procedures, or conduct intended to undermine marketplace integrity or user trust.
- Attempting to evade suspensions, restrictions, bans, verification requirements, payment reviews, or enforcement measures through replacement accounts, deceptive activity, technical circumvention, or related misconduct.
SMP reserves broad discretion to investigate suspected violations of these Community Guidelines & Marketplace Conduct Policy and may remove content, void bids, suspend or terminate accounts, freeze transactions or payouts, restrict marketplace participation, preserve evidence, cooperate with legal authorities, and take additional operational, technical, legal, or enforcement measures reasonably necessary to protect users, marketplace integrity, operational stability, compliance obligations, and the overall safety and security of the Platform.
5. LISTING & CONTENT STANDARDS
5.1 Accurate Vehicle Descriptions
All listings, Project descriptions, Garage content, and related marketplace information must be accurate, truthful, complete, and not misleading. Sellers and users are responsible for ensuring that vehicle information, restoration details, modifications, ownership status, build history, specifications, condition disclosures, and related descriptions accurately reflect the applicable Project.
Users may not publish false or deceptive descriptions, misleading restoration claims, fabricated build details, inaccurate ownership information, manipulated performance claims, or incomplete disclosures intended to mislead Buyers or marketplace participants. Marketplace transparency and user trust depend on honest and accurate listings.
5.2 Photo & Video Requirements
Photos, videos, and visual media uploaded to the Platform must accurately depict the applicable Project, listing, or marketplace activity. Visual content should be clear, relevant, authentic, and reasonably representative of the vehicle or subject matter being presented.
Users may not upload misleading or manipulated images, stolen photos and videos, unrelated media, deceptive editing intended to conceal defects, infringing content, unlawful material, or media intended to mislead marketplace participants. SMP may establish additional image, formatting, or documentation standards relating to Auctions, listings, Garage profiles, or promotional content.
5.3 VIN, Title & Ownership Disclosures
Users listing Projects through the Platform are responsible for accurately disclosing VIN information, title status, ownership authority, lien information, registration details, and related ownership documentation where applicable.
Users may not submit fake VINs, alter ownership documentation, conceal title issues, misrepresent lien status, list stolen vehicles, or offer vehicles without lawful authority to sell or transfer them. SMP may request additional documentation, ownership verification, title records, or supporting materials where reasonably necessary to protect marketplace integrity or comply with legal obligations.
5.4 Defect & Damage Disclosure Expectations
Sellers and marketplace participants are expected to disclose known material defects, damage history, missing components, restoration issues, fabrication concerns, mechanical problems, title complications, or other information reasonably relevant to a Buyer's evaluation of a Project.
Prohibited conduct includes concealing known defects, intentionally omitting material information, misrepresenting restoration quality, hiding major damage, misleading Buyers regarding operability or condition, or providing deceptive inspection or repair information. Users remain responsible for conducting independent inspections and due diligence, and SMP does not independently verify vehicle condition or disclosures.
5.5 Prohibited Listing Content
Users may not upload, publish, distribute, or promote content through the Platform that is unlawful, fraudulent, deceptive, abusive, infringing, harmful, or inconsistent with marketplace integrity standards.
Prohibited content may include fake listings, unlawful sales activity, hate speech, harassment, spam, phishing content, malicious links, infringing materials, deceptive advertising, explicit unlawful content, or content intended to manipulate marketplace activity or user behavior. SMP reserves the right to remove prohibited content and take enforcement action where reasonably necessary to protect users, operational stability, or marketplace integrity.
5.6 User-Generated Content Standards
Users remain solely responsible for content they upload, publish, transmit, display, or otherwise make available through the Platform, including listings, comments, public Q&A, Garage content, photos, videos, and marketplace communications.
User-generated content must comply with applicable laws, intellectual property rights, privacy rights, Platform policies, marketplace standards, and community expectations established by SMP. SMP may review, moderate, organize, preserve, restrict, remove, or investigate user-generated content for moderation, fraud prevention, operational, legal compliance, security, or marketplace integrity purposes.
5.7 SMP Moderation & Removal Rights
SMP reserves broad discretion to review, moderate, remove, restrict, suspend, preserve, or investigate listings, content, comments, Garage activity, media, communications, or marketplace interactions that violate these Guidelines, Platform policies, applicable law, or marketplace integrity standards.
SMP may take enforcement action with or without prior notice where reasonably necessary to prevent fraud, protect users, maintain operational stability, address legal or compliance concerns, preserve evidence, enforce Platform rules, or maintain a safe and trustworthy marketplace environment. SMP is not obligated to publish, maintain, or continue displaying any listing, content, or marketplace activity and may remove or restrict content at its discretion.
6. AUCTION INTEGRITY RULES
6.1 Legitimate Bidding Requirements
All bids submitted through the Platform must be legitimate, made in good faith, and submitted by users who are legally authorized and financially capable of completing the applicable transaction. Buyers may participate in Auctions only for genuine marketplace purposes and may not submit bids for deceptive, manipulative, disruptive, or fraudulent reasons.
Users are responsible for reviewing listings, understanding Auction procedures, evaluating Projects, and ensuring that submitted bids reflect a genuine intent to complete the transaction if selected as the winning bidder. SMP reserves the right to verify bidding activity, investigate suspicious conduct, and restrict participation where necessary to maintain Auction integrity and marketplace trust.
6.2 No Bid Manipulation or Artificial Pricing
Users may not manipulate Auctions, artificially influence pricing, distort marketplace activity, or interfere with fair bidding processes. Prohibited conduct includes shill bidding, coordinated bidding schemes, fake bids, artificial price inflation, bid suppression, duplicate-account manipulation, deceptive engagement activity, or any conduct intended to create misleading Auction outcomes or marketplace signals.
Users may not bid on their own listings, coordinate bidding with third parties, use multiple accounts to influence Auctions, create fake bidding activity, artificially inflate visibility or pricing, or interfere with legitimate marketplace participation. SMP reserves broad discretion to investigate suspicious bidding behavior, void bids, freeze Auctions, suspend accounts, restrict marketplace participation, preserve evidence, and take additional enforcement action where reasonably necessary to protect marketplace integrity.
6.3 Binding Bid Expectations
All bids submitted through the Platform, including Send It activations and subsequent Auction bids, are intended to create binding marketplace obligations. Buyers are expected to honor winning bids and complete applicable transactions in accordance with the Terms of Service, Buyer Terms, Seller Terms, Auction Rules, and related Platform policies.
Users may not submit bids without intent to purchase, for entertainment purposes, to manipulate Auction activity, to disrupt marketplace operations, or to interfere with legitimate transactions.
Failure to complete a transaction following a valid winning bid may result in account restrictions, Marketplace penalties, financial liability, suspension, loss of bidding privileges, or additional enforcement action by SMP.
6.4 No Auction Interference
Users may not interfere with ongoing Auctions, marketplace participation, transaction processes, or legitimate bidding activity. Prohibited conduct includes disrupting Auctions, interfering with bidder participation, encouraging rule violations, attempting to improperly influence transaction outcomes, or engaging in conduct intended to undermine marketplace fairness or operational stability.
Users may not disrupt Auction functionality, interfere with countdown procedures, manipulate visibility or engagement, pressure users into off-platform transactions, suppress legitimate bids, spread false information about Projects or Auctions, or otherwise compromise fair marketplace participation.
SMP reserves the right to investigate interference and take immediate enforcement action, where necessary, to protect Auctions, users, and marketplace operations.
6.5 Send It Auction Conduct
The Send It mechanic is intended to facilitate legitimate marketplace participation and Auction activation by qualified Buyers acting in good faith. Users activating Send It Auctions acknowledge that doing so initiates binding marketplace activity and may trigger public Auctions, bid visibility, community engagement, transaction obligations, and related marketplace consequences.
Users may not misuse the Send It mechanic to create fake Auctions, manipulate marketplace activity, generate artificial engagement, interfere with Projects or listings, pressure Sellers or Buyers, avoid transaction obligations, or otherwise disrupt marketplace operations.
SMP reserves the right to delay, suspend, reject, freeze, investigate, or cancel Send It Auctions where fraud-prevention, operational, compliance, technical, verification, or marketplace-integrity concerns arise.
6.6 SMP Authority Over Auction Activity
SMP reserves broad discretion over the operation, administration, moderation, investigation, and enforcement of Auctions and marketplace activity. SMP may review Auction conduct, reject or void bids, delay or cancel Auctions, freeze transactions, suspend accounts, investigate suspicious activity, preserve records, restrict participation, revoke winning status, or take other enforcement measures reasonably necessary to protect the Platform, users, compliance obligations, operational stability, or marketplace integrity.
SMP does not guarantee uninterrupted Auction functionality, real-time synchronization, continuous marketplace availability, or error-free operation of Auction systems. SMP may modify Auction procedures, timing rules, extension settings, visibility features, moderation practices, or enforcement standards at any time in its discretion.
7. COMMUNITY FEATURES & ENGAGEMENT
7.1 Garage Profiles & Community Participation
The Platform includes Garage profiles, community features, and engagement tools intended to encourage collaboration, creativity, marketplace participation, and interaction among automotive enthusiasts. Users may create Garage profiles, showcase Projects, participate in Auctions, engage with community features, and contribute content relating to builds, restorations, fabrication work, and marketplace activity.
Users are responsible for ensuring that Garage content, profile information, uploaded materials, comments, and community participation comply with these Guidelines, applicable laws, and Platform policies. SMP reserves the right to moderate, organize, restrict, remove, or feature Garage content and community activity in its discretion.
7.2 Crew Participation Standards
Crew participation features are intended to support community engagement, marketplace collaboration, visibility, and user interaction across the Platform. Users participating in Crew activity are expected to engage honestly, respectfully, and in good faith.
Users may not use Crew features to manipulate marketplace visibility, generate fake engagement, coordinate deceptive activity, harass users, interfere with Auctions, spam marketplace participants, or undermine marketplace integrity. SMP reserves the right to investigate suspicious Crew activity, adjust visibility settings, restrict participation, remove content, modify engagement features, or take enforcement action where reasonably necessary to protect community trust and marketplace fairness.
7.3 Comments, Public Q&A & Discussions
Users may participate in comments, public listing Q&A, discussions, Messages for marketplace listings, and related community interactions through the Platform. Before an auction ends, buyer and seller questions about a build should be asked in the public Q&A on the listing. Marketplace buyers and sellers may use Messages to chat about listings. All communications must remain respectful, lawful, accurate, and consistent with these Guidelines and marketplace standards.
Users may not use communication features to engage in harassment, threats, hate speech, spam, scams, deceptive conduct, unlawful solicitations, impersonation, abusive behavior, or off-platform circumvention activity. SMP may monitor, moderate, preserve, review, restrict, or remove communications as reasonably necessary for moderation, fraud prevention, legal compliance, operational security, dispute resolution, or marketplace integrity purposes.
7.4 Social Sharing & Promotions
The Platform may allow users to share listings, Projects, Auctions, Garage content, or marketplace activity through social-media features, promotional tools, or community-sharing functionality. Users may engage in promotional activity only in a manner that is lawful, accurate, non-deceptive, and consistent with Platform policies.
Users may not create misleading promotions, manipulate engagement metrics, conduct unauthorized advertising, misuse SMP branding, impersonate SMP representatives, engage in spam campaigns, or use promotional activity to deceive users or circumvent marketplace rules. SMP reserves the right to restrict, remove, moderate, or investigate promotional activity or social-sharing conduct that may harm users, the Platform, or marketplace integrity.
7.5 Reputation Systems & Trust Scores
The Platform may use Trust Scores, reputation systems, engagement metrics, badges, participation indicators, or other marketplace signals to support transparency and community trust. Such systems may consider account activity, transaction history, marketplace participation, verification status, user conduct, dispute history, or related operational factors.
Users may not manipulate, artificially influence, exploit, or interfere with reputation systems or Trust Scores through deceptive conduct, fake engagement, duplicate accounts, coordinated activity, or other abusive practices. SMP reserves broad discretion regarding calculation, visibility, adjustment, removal, suspension, or interpretation of reputation indicators, Trust Scores, and related marketplace metrics.
7.6 Public Marketplace Conduct Expectations
Because the Platform operates as a public and community-driven marketplace, users are expected to conduct themselves in a professional, respectful, honest, and responsible manner during all public marketplace activity. Public conduct expectations apply to Auctions, comments and discussions, Garage activity, profile content, community engagement, marketplace interactions, social-sharing activity, and communications relating to Projects, transactions, or marketplace participation.
Users acknowledge that marketplace activity may be publicly visible and may affect reputation, Trust Scores, account standing, marketplace privileges, or community participation status. SMP reserves the right to investigate public conduct that may threaten user safety, operational stability, marketplace fairness, or community trust and may take enforcement action where reasonably necessary to maintain a safe and trustworthy marketplace environment.
8. FRAUD PREVENTION & SECURITY
Users are responsible for maintaining the confidentiality and security of their account credentials, authentication methods, devices, payment information, and login access associated with the Platform. Users must take reasonable precautions to prevent unauthorized access, account misuse, fraud, identity theft, or compromise of marketplace activity.
Users are responsible for all activity conducted through their accounts, including bids and Auction participation, listings and Garage activity, communications, transactions, payment activity, and marketplace interactions, all of which are conducted using their credentials or account access. Users must promptly notify SMP if they become aware of unauthorized access, suspicious activity, security incidents, account compromise, fraudulent conduct, or misuse of their accounts or payment methods.
Users agree to cooperate with SMP's identity verification, fraud prevention, security, and compliance procedures as reasonably requested. SMP may require users to provide verification documentation, proof of ownership, payment verification, identification records, business information, title documentation, or related materials necessary to confirm account legitimacy, transaction authority, or compliance obligations.
Failure to cooperate with verification procedures may result in account restrictions, delayed transactions, frozen payouts, Auction limitations, listing removal, suspension of marketplace privileges, or permanent removal from the Platform. SMP reserves the right to utilize third-party identity-verification, fraud-detection, compliance, and risk-management providers in connection with marketplace security and operational integrity.
Users are encouraged to promptly report suspected fraud, suspicious behavior, deceptive conduct, security concerns, payment abuse, fake listings, Auction manipulation, account compromise, or other activity that may threaten users, transactions, or marketplace integrity.
Reports may include concerns relating to fraudulent listings, fake bids, impersonation, scams, chargeback abuse, account takeovers, unauthorized transactions, malicious communications, or other suspicious marketplace activity. SMP may investigate reported activity, preserve records, restrict marketplace participation, cooperate with payment providers or legal authorities, and take enforcement action reasonably necessary to protect users and operational security.
Users may not engage in fraudulent payment activity, unauthorized payment disputes, abusive chargebacks, deceptive refund requests, payment manipulation, stolen-payment-method use, or conduct intended to improperly avoid marketplace obligations or financial responsibilities.
Prohibited conduct includes submitting fraudulent chargebacks, disputing valid transactions in bad faith, using unauthorized payment methods, engaging in payment fraud, manipulating payout systems, or interfering with legitimate financial transactions. SMP reserves the right to freeze transactions, withhold payouts, recover losses, restrict marketplace access, preserve evidence, cooperate with financial institutions, and pursue enforcement or legal remedies relating to payment abuse or financial misconduct.
SMP utilizes administrative, technical, operational, and security measures intended to protect the Platform, users, marketplace activity, and transaction systems from fraud, abuse, unauthorized access, malicious activity, data compromise, or operational disruption.
Security protections may include authentication systems, behavioral monitoring, fraud-detection tools, audit logs, moderation systems, automated risk analysis, device-recognition technologies, access controls, and third-party security or compliance providers. Despite these measures, no online marketplace, communication system, payment platform, or internet-based service can guarantee complete security or uninterrupted protection from cyber threats, fraud, technical failures, or unauthorized activity.
Users agree to reasonably cooperate with investigations into fraud, suspicious activity, payment disputes, chargebacks, security incidents, identity verification, legal compliance, Auction manipulation, intellectual property claims, or the enforcement of Platform policies.
SMP may request supporting documentation, communications, transaction records, payment information, ownership records, device information, verification materials, or other evidence reasonably necessary to investigate marketplace activity or protect operational integrity.
Failure to cooperate with investigations may result in account suspension, transaction cancellation, payout restrictions, removal of listings, permanent marketplace bans, or additional enforcement action deemed reasonably necessary by SMP.
9. INTELLECTUAL PROPERTY & CONTENT RIGHTS
9.1 Ownership of User Content
Users retain ownership of content they upload, publish, submit, display, or otherwise make available through the Platform, including listings, photos, videos, Garage content, comments, descriptions, Project information, communications, and related user-generated materials ("User Content").
By submitting User Content through the Platform, users represent and warrant that they own the applicable content, possess all necessary rights, permissions, licenses, and authority to use and publish the content, have the authority to grant the rights described in SMP's Terms and policies, and are not violating any intellectual property, privacy, publicity, contractual, or legal rights of third parties. Users remain solely responsible for User Content they upload or publish through the Platform.
9.2 Copyright & DMCA Compliance
SMP respects intellectual property rights and expects users to comply with applicable copyright laws, including the Digital Millennium Copyright Act ("DMCA") and related intellectual property regulations.
Users may not upload, publish, distribute, reproduce, transmit, or otherwise use copyrighted materials without proper authorization or legal rights to do so. Prohibited conduct includes unauthorized use of photos or videos, copying listings or Garage content, reproducing protected media, distributing infringing materials, or using copyrighted works without appropriate permission.
SMP reserves the right to remove allegedly infringing content, disable access to disputed materials, request additional information, preserve records relating to infringement claims, terminate repeat infringers, and comply with applicable copyright laws, subpoenas, or legal procedures. Copyright complaints must be submitted using SMP's designated DMCA or intellectual-property reporting procedures.
9.3 Trademark & Brand Protection
Users may not misuse, infringe, dilute, imitate, misrepresent, or otherwise improperly use trademarks, service marks, trade dress, logos, branding, business names, Garage names, or other brand identifiers belonging to SMP or third parties.
Prohibited conduct includes impersonating businesses or brands, unauthorized use of logos, misleading affiliation claims, counterfeit branding, deceptive promotional activity, or misuse of SMP branding in advertisements, listings, social media, or marketplace communications.
SMP reserves the right to remove infringing content, restrict accounts, investigate misuse of branding or trademarks, and take enforcement action reasonably necessary to protect intellectual property rights and marketplace integrity.
9.4 Unauthorized Use of Platform Content
Users may not copy, scrape, reproduce, distribute, exploit, modify, republish, sell, reverse engineer, or commercially use Platform content, marketplace data, listings, photos, videos, Garage content, Auction information, Trust Scores, engagement metrics, or related materials without SMP's prior written authorization or other lawful permission.
Prohibited conduct includes unauthorized scraping or harvesting of marketplace data, reproduction of listings or Auction information, automated collection of user content, misuse of marketplace analytics, commercial resale of Platform content, or unauthorized use of SMP systems, branding, or proprietary marketplace materials. SMP reserves all rights relating to the Platform, marketplace systems, operational processes, branding, software, and related intellectual property not expressly granted to users.
9.5 Repeat Infringer Policy
SMP reserves the right to suspend, restrict, terminate, or permanently ban users who repeatedly violate intellectual property rights, copyright laws, trademark protections, or related Platform policies. SMP may consider repeated infringement complaints, prior enforcement history, severity of violations, evidence of intentional infringement, marketplace impact, and operational or legal risk when determining appropriate enforcement action.
SMP may remove listings, disable accounts, preserve evidence, cooperate with rights holders or legal authorities, and take additional operational or legal measures reasonably necessary to protect intellectual property rights, users, and marketplace integrity.
10. REPORTING VIOLATIONS
10.1 Reporting Marketplace Violations
Users are encouraged to report conduct, listings, communications, Auctions, transactions, or marketplace activity that may violate these Guidelines, the Terms of Service, applicable laws, or marketplace integrity standards. Reports may relate to fraudulent activity, deceptive listings, Auction manipulation, abusive conduct, policy violations, suspicious behavior, unlawful activity, or other concerns affecting users or marketplace operations.
SMP may review reported activity, preserve records, investigate relevant information, request supporting documentation, and take enforcement action reasonably necessary to protect users, marketplace integrity, operational stability, or compliance obligations.
10.2 Reporting Fraud or Abuse
Users may report suspected fraud, scams, chargeback abuse, impersonation, account compromise, payment fraud, fake listings, shill bidding, spam, malicious activity, harassment, or other abusive conduct affecting the Platform or marketplace participants.
Reports should include reasonably accurate and complete information where available, including usernames, listing information, screenshots, transaction details, communications, payment information, or other supporting materials relevant to the reported conduct. SMP may cooperate with payment providers, regulators, law enforcement agencies, or fraud-prevention vendors where reasonably necessary to investigate or address suspected fraud or abusive conduct.
10.3 Reporting Intellectual Property Violations
Users, rights holders, and authorized representatives may report alleged copyright infringement, trademark violations, counterfeit activity, unauthorized use of content, or other intellectual property concerns relating to the Platform or marketplace activity.
Intellectual property complaints should include sufficient information reasonably necessary for SMP to review the claim, which may include identification of the allegedly infringed work, identification of the disputed content, ownership or authorization information, contact information, and supporting documentation or legal notices where applicable.
SMP reserves the right to remove allegedly infringing content, disable access, preserve records, request additional information, terminate repeat infringers, and comply with applicable intellectual property laws and legal procedures.
10.4 User Cooperation Expectations
Users agree to reasonably cooperate with SMP in connection with investigations, moderation reviews, fraud-prevention efforts, intellectual property disputes, security matters, payment disputes, legal-compliance reviews, or the enforcement of Platform policies.
SMP may request supporting documentation, communications, transaction records, ownership information, screenshots, payment details, verification materials, or other information reasonably necessary to review reported conduct or protect marketplace integrity.
Failure to cooperate with investigations or moderation procedures may result in account restrictions, listing removal, transaction cancellation, suspension, or additional enforcement action.
10.5 False or Abusive Reports
Users may not knowingly submit false, misleading, malicious, retaliatory, abusive, or fraudulent reports through the Platform or moderation systems.
Prohibited conduct includes filing intentionally false complaints, abusing reporting systems to harass users, submitting fraudulent intellectual property claims, attempting to interfere with legitimate marketplace activity through false reports, or using moderation systems to manipulate Auctions, listings, Trust Scores, or marketplace participation.
SMP reserves the right to investigate abusive reporting conduct and may restrict reporting privileges, suspend accounts, remove content, or take additional enforcement action where reasonably necessary to protect users, moderation systems, and marketplace integrity.
11. ENFORCEMENT & PENALTIES
11.1 Content Moderation Rights
SMP reserves broad discretion to review, moderate, restrict, remove, edit, organize, preserve, or investigate listings, comments, public Q&A, Garage content, photos, videos, user-generated content, Auctions, and related marketplace activity that may violate these Guidelines, applicable laws, intellectual property rights, or marketplace integrity standards.
Moderation decisions may be based on user reports, automated monitoring systems, fraud-prevention reviews, legal or compliance concerns, operational risks, security threats, or internal marketplace-integrity evaluations. SMP is not obligated to publish, maintain, or continue displaying any content or marketplace activity and may take moderation action with or without prior notice where reasonably necessary.
11.2 Listing Removal & Auction Cancellation
SMP reserves the right to remove listings, suspend Projects, void bids, cancel Auctions, freeze marketplace activity, restrict visibility, or terminate transactions where reasonably necessary to address fraud concerns, deceptive conduct, inaccurate disclosures, policy violations, payment risks, technical issues, operational concerns, legal compliance matters, or marketplace-integrity risks.
SMP may also remove listings or cancel Auctions where ownership, title status, verification information, or marketplace legitimacy cannot be reasonably confirmed. Users acknowledge that SMP is not obligated to maintain any listing, Auction, or marketplace activity on the Platform.
11.3 Account Restrictions & Suspensions
SMP may suspend, restrict, freeze, deactivate, or limit user accounts, Garage profiles, marketplace privileges, bidding activity, listing access, communications, transactions, payouts, or related Platform functionality where reasonably necessary to protect users, operational stability, compliance obligations, or marketplace integrity.
Grounds for account restrictions may include fraud or suspicious activity, shill bidding, fake listings, abusive conduct, payment disputes, repeated complaints, policy violations, security risks, impersonation, unlawful activity, or failure to cooperate with investigations or verification procedures.
SMP may impose temporary or permanent restrictions depending on the nature, severity, frequency, or risk associated with the conduct at issue.
11.4 Permanent Marketplace Bans
SMP reserves the right to permanently remove users from the Platform for serious, repeated, intentional, fraudulent, abusive, unlawful, or high-risk conduct that threatens marketplace integrity, user safety, operational stability, or compliance obligations.
Permanent bans may apply to individual accounts, related accounts, Garage profiles, payment methods, associated businesses, devices, IP addresses, or related marketplace activity connected to prohibited conduct. Users subject to permanent bans may not create replacement accounts, evade enforcement measures, or otherwise attempt to regain unauthorized access to the Platform.
11.5 Payment Holds & Transaction Restrictions
SMP may freeze, delay, withhold, restrict, reverse, or review payments, payouts, transactions, or marketplace activity where reasonably necessary to address fraud risks, chargebacks, payment disputes, suspicious financial activity, compliance obligations, verification concerns, legal requirements, or operational or marketplace-integrity risks.
SMP may also impose transaction limitations, payout reviews, reserve requirements, or additional verification procedures in connection with high-risk marketplace activity or suspected violations of these Guidelines.
11.6 Preservation of Records & Evidence
SMP reserves the right to preserve records, communications, transaction histories, audit logs, marketplace activity, payment information, IP data, verification materials, moderation records, and related evidence where reasonably necessary for fraud prevention, investigations, dispute resolution, legal compliance, enforcement activity, security purposes, or protection of the Platform and its users.
Preserved records may be retained even after account suspension, transaction cancellation, listing removal, or termination of marketplace participation.
11.7 Cooperation with Legal Authorities
SMP may cooperate with regulators, courts, law enforcement agencies, payment providers, governmental authorities, arbitrators, intellectual property rights holders, or other authorized parties regarding investigations, subpoenas, fraud matters, payment disputes, legal requests, intellectual property claims, consumer complaints, security incidents, or compliance obligations.
SMP may disclose information, preserve records, restrict marketplace access, or take other actions reasonably necessary to comply with applicable law, legal process, or lawful governmental requests.
11.8 SMP Discretion & Enforcement Authority
SMP reserves broad discretion to interpret, administer, investigate, enforce, and apply these Guidelines, the Terms of Service, Auction Rules, and related Platform policies. Enforcement decisions may be based on operational, technical, legal, security, fraud-prevention, reputational, compliance, or marketplace-integrity considerations.
SMP may take enforcement action with or without prior notice where reasonably necessary to protect users, maintain operational stability, prevent fraud or abuse, preserve marketplace integrity, enforce Platform policies, or comply with legal obligations.
SMP is not required to disclose internal moderation standards, enforcement methodologies, fraud-detection systems, risk assessments, or investigative procedures and may make enforcement decisions in its sole discretion to the fullest extent permitted by law.
12. DISCLAIMERS & LIMITATION OF RESPONSIBILITY
12.1 User Responsibility for Conduct
Users are solely responsible for their conduct, communications, listings, bids, transactions, Garage activity, uploaded content, payment activity, and marketplace participation through or relating to the Platform. Users are responsible for ensuring that their conduct complies with these Guidelines, the Terms of Service, applicable laws, intellectual property rights, and marketplace standards.
SMP does not control, direct, or guarantee user behavior and is not responsible for the actions, omissions, representations, communications, or conduct of Buyers, Sellers, Garage accounts, Crew participants, or other marketplace users.
12.2 No Guarantee of Marketplace Behavior
SMP does not guarantee the accuracy, reliability, honesty, legality, safety, authenticity, or quality of marketplace activity, user conduct, listings, communications, Projects, transactions, Auctions, or community interactions occurring through the Platform.
Users acknowledge that marketplace participation involves inherent risks: users may provide inaccurate or misleading information; transactions may involve disputes or complications; Auctions may be affected by technical or operational issues; and marketplace interactions occur at users' own risk.
Users remain solely responsible for conducting independent due diligence, evaluating marketplace activity, verifying information, and assessing risks associated with Auctions, Projects, transactions, and communications.
12.3 SMP as Marketplace Facilitator
SMP operates solely as a marketplace facilitator and technology platform that enables users to participate in Auctions, marketplace activity, community engagement, and related transactions. SMP does not own, inspect, broker, certify, guarantee, store, transport, appraise, or transfer vehicles or Projects listed through the Platform.
SMP is not a party to transactions between users. It does not guarantee completion of transactions, payment performance, vehicle condition, title status, legal compliance, transaction legitimacy, or user performance or conduct. Users acknowledge that transactions are conducted directly between marketplace participants and that SMP's role is limited to providing marketplace functionality and related operational services.
12.4 No Duty to Monitor All Activity
Although SMP may utilize moderation systems, fraud-prevention tools, security measures, automated monitoring technologies, and user-reporting mechanisms, it is not obligated to monitor all listings, communications, Auctions, transactions, comments, Garage activity, or marketplace conduct.
SMP does not guarantee that all prohibited conduct will be detected, all violations will be investigated, all listings or communications will be reviewed, fraudulent activity will be prevented, or marketplace activity will remain uninterrupted, secure, or error-free. Users acknowledge that SMP may review, moderate, investigate, remove, preserve, or restrict marketplace activity at its discretion but assumes no duty to continuously supervise or actively monitor all Platform activity.
13. CHANGES TO THESE GUIDELINES
SMP reserves the right to update, revise, modify, supplement, or replace these Community Guidelines & Marketplace Conduct Policy at any time to reflect changes in marketplace operations, Platform functionality, community standards, legal or regulatory requirements, fraud-prevention practices, security measures, moderation procedures, or operational and business needs.
Updated versions of these Guidelines become effective upon posting or other notice provided by SMP unless otherwise required by applicable law. SMP may also modify enforcement standards, moderation practices, reporting procedures, Auction rules, community features, or marketplace requirements in its discretion.
Where reasonably appropriate or required by applicable law, SMP may provide notice of material changes to these Guidelines through Platform notifications, updated effective dates, account alerts, email communications, banner notices, announcements through the Platform, or other reasonable communication methods. Users are responsible for periodically reviewing these Guidelines and related Platform policies to remain informed regarding current marketplace rules, moderation standards, enforcement practices, and community expectations.
Continued access to or use of the Platform following the effective date of updated Guidelines constitutes acknowledgment and acceptance of the revised Guidelines to the fullest extent permitted by law.
If a user does not agree with updated Guidelines, the user must discontinue use of the Platform and related marketplace services. Continued participation in Auctions, listings, Garage activity, transactions, public Q&A, community engagement, or marketplace participation after updated Guidelines become effective may constitute acceptance of the revised terms and policies.

Users may report suspected violations of these Guidelines, fraudulent activity, abusive conduct, deceptive marketplace behavior, suspicious Auctions, fake listings, spam, harassment, security concerns, or other marketplace-integrity issues through the support and reporting channels identified on the Platform or by email at chad@sellmyproject.com.
Reports should include reasonably accurate and complete information where available, including usernames, listing information, screenshots, transaction details, communications, or other supporting materials relevant to the reported conduct.
14.2 Support & Community Questions
Users may contact SMP regarding community standards, moderation concerns, account issues, Auctions, Garage activity, transactions, technical-support matters, marketplace participation, or general community questions through the contact methods and support channels identified on the Platform or by email at chad@sellmyproject.com.
SMP does not guarantee response times, issue resolution, or specific moderation outcomes and reserves the right to prioritize support, enforcement, security, and operational matters in its discretion.
14.3 DMCA & Intellectual Property Complaints
Copyright, trademark, intellectual property, or infringement-related complaints must be submitted through SMP's designated intellectual property or DMCA reporting procedures or by email at chad@sellmyproject.com.
Intellectual property complaints should include reasonably sufficient information to allow SMP to review and investigate the applicable claim, which may include identification of the allegedly infringed work, identification of the disputed content, ownership or authorization information, contact information, and supporting documentation or legal notices, where applicable.
SMP reserves the right to remove allegedly infringing content, disable access, preserve records, request additional information, terminate repeat infringers, and comply with applicable intellectual property laws and legal procedures.
14.4 Legal & Regulatory Communications
Legal notices, subpoenas, arbitration demands, governmental requests, regulatory inquiries, law-enforcement communications, or other formal legal matters relating to the Platform or these Guidelines must be submitted using SMP's designated legal contact methods or by email at chad@sellmyproject.com. Communications submitted through customer-support channels, social media, comments, or informal messaging systems may not constitute valid legal notice.
SMP reserves the right to cooperate with regulators, courts, law enforcement agencies, payment providers, governmental authorities, or authorized third parties regarding investigations, legal requests, compliance obligations, fraud matters, intellectual property disputes, consumer complaints, or operational and marketplace-integrity concerns.
